Terms and Conditions

These Terms and Conditions ("Terms") govern your use of airemia.com (the "Site") and your entry to and conduct at AIRE Miami, 111 NE 20th Street, Miami, Florida 33137 (the "Venue"), operated by Mr. Wright LLC d/b/a AIRE Miami ("AIRE," "we," "us," or "our").

By using the Site, submitting a reservation or guest list request, purchasing a ticket, or entering the Venue, you agree to these Terms. If you do not agree, do not use the Site and do not enter the Venue.

Please also review our Privacy Policy, which explains how we handle your information.


1. Eligibility

You must be at least 18 years old to use the Site. Entry to the Venue requires valid, unexpired government-issued photo identification showing you are at least 21 years of age. We accept a state driver's license, a state ID card, or a passport. Photocopies and digital images of identification are not accepted.


2. Use of the Site

You may use the Site for personal, non-commercial purposes. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Copy, scrape, mirror, or republish any part of the Site without written permission
  • Use automated systems to access the Site in a way that burdens our infrastructure
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Impersonate another person or submit false information
  • Interfere with the security of the Site

We may suspend or terminate your access to the Site at any time.


3. Reservations, tables, and bottle service

Requests are not confirmations. Submitting a table request through the Site starts a conversation. A reservation exists only once our host team confirms it directly with you in writing.

Minimums. Table minimums vary by night, section, event, and party size, and are quoted at the time of booking. Minimums are spend requirements, not deposits, and do not include tax or service charge.

Deposits. Some nights and events require a deposit or a card on file to hold a table. Deposits are applied to your minimum unless stated otherwise. Deposits are arranged directly with our team, never through the Site.

Cancellations and changes. Cancellations made at least 48 hours before your reservation are eligible for a full refund of any deposit. Cancellations inside 48 hours and no-shows forfeit the deposit.

Arrival and release. Tables are held for 30 minutes past the reservation time. After that, we may release the table to another party and any deposit is forfeited. Please contact us if you are running late.

Taxes and service charge. A service charge and applicable Florida and Miami-Dade County sales tax are added to all beverage purchases. The current service charge is shown on our drinks list and at the point of sale. The service charge is not a gratuity for staff. Additional gratuity is at your discretion.

Guest count. Tables are priced and staffed for a stated party size. Additional guests may require a larger table, a higher minimum, or may not be accommodated.

Alcohol service. We serve alcohol only to guests 21 and over with valid identification. Our staff may refuse or discontinue service to anyone at any time, including anyone who appears intoxicated, and no refund of a minimum or deposit is owed as a result.


4. Guest list

Adding your name to a guest list is a request, not a guarantee of entry. Guest list entry is subject to capacity, arrival before any stated cutoff time, valid identification, and the discretion of our door team. Guest list is not transferable and may be limited by party size or composition on a given night.


5. Tickets and events

Third-party sellers. Tickets to events at AIRE may be sold through third-party platforms. Those platforms have their own terms, fees, and refund policies, which apply in addition to these Terms.

All sales final. Unless stated otherwise at the time of purchase or required by law, tickets are non-refundable and non-exchangeable.

Lineups change. Artists, DJs, set times, support acts, and programming are subject to change without notice. A change in lineup is not grounds for a refund.

Cancellation and postponement. If an event is cancelled outright, ticket holders are entitled to a refund of the face value, processed through the original point of purchase. Service and processing fees may be non-refundable. If an event is postponed or rescheduled, tickets are valid for the new date.

Resale. Tickets may not be resold above face value or used for commercial, promotional, or sweepstakes purposes without our written permission. We may void tickets we believe have been resold in violation of these Terms or obtained fraudulently.

Open-air venue and weather. AIRE is an open-air venue with covered sections. Events proceed in most weather conditions. Rain, wind, temperature, or other weather is not grounds for a refund unless we cancel the event entirely.


6. Entry, search, and refusal

Right of admission. We reserve the right to refuse entry to, or remove, any person at our discretion, including for intoxication, aggressive or unsafe behavior, harassment, possession of prohibited items, providing false identification, or violating these Terms. Refusal or removal does not entitle you to a refund of any ticket, deposit, or minimum. Admission decisions are never made on the basis of race, color, religion, sex, national origin, disability, age, or any other basis protected by law.

Search. Entry is conditional on consent to a search of your person and belongings by our security staff. If you decline, you will not be admitted.

Prohibited items. Weapons of any kind, illegal substances, outside beverages or refreshments, professional cameras and recording equipment without prior written approval, drones, laser pointers, and any item our security team deems unsafe.

Re-entry. Re-entry is at the discretion of the door team and may be refused at any time.


7. Conduct in the Venue

You agree to follow all posted rules and the instructions of AIRE staff and security. The following will result in removal without refund and may result in a ban from the Venue:

  • Possession, use, or distribution of illegal substances
  • Violence, threats, or harassment of any kind toward guests or staff
  • Unwanted physical contact or sexual harassment
  • Damaging or defacing property
  • Entering areas marked for staff or artists, including the DJ booth, without authorization
  • Bringing outside alcohol into the Venue or removing alcohol from it
  • Attempting to provide alcohol to anyone under 21

We take reports of harassment seriously. Tell any staff member and it will be handled.


8. Assumption of risk and health notice

By entering the Venue you acknowledge and accept the following:

  • Sound levels. The Venue plays amplified music at high volume for extended periods. Exposure may cause temporary or permanent hearing damage. Ear protection is available on request.
  • Lighting. Performances may include strobe lighting, lasers, haze, and other effects that can affect people with photosensitive conditions, including photosensitive epilepsy.
  • Physical activity and environment. Dancing, crowds, uneven or wet surfaces, low light, stairs, and an open-air environment carry inherent risks of injury.
  • Assumption of risk. You voluntarily assume all risks associated with attending, to the fullest extent permitted by Florida law.

9. Photography, recording, and your likeness

AIRE photographs, films, and records inside the Venue for marketing, editorial, and archival purposes.

By entering the Venue, you grant AIRE and its partners the irrevocable, worldwide, royalty-free right to record, photograph, and use your name, image, likeness, and voice in any medium now known or later developed, for promotional and commercial purposes, without further notice, approval, compensation, or credit. If you do not wish to be recorded, do not enter the Venue.

Personal recording. You may take photos and short videos for personal, non-commercial use. Professional cameras, detachable-lens cameras, audio recording equipment, gimbals, lighting rigs, and drones require prior written approval from AIRE.

Commercial and press recording. Any filming, photography, or recording for commercial, press, editorial, or content-creation purposes requires prior written approval. Contact info@airemia.com.

Artist restrictions. Some performing artists restrict recording of their sets. Where that applies, it will be communicated and enforced at the Venue.


10. Private events and buyouts

Private events, brand activations, and full or partial buyouts are governed by a separate written agreement between AIRE and the client. Where that agreement conflicts with these Terms, the agreement controls for that event.


11. Promotions and contests

Any giveaway, contest, or promotion run by AIRE is governed by its own official rules, published with the promotion. Where those rules conflict with these Terms, the rules control for that promotion. Promotions run on Instagram, Facebook, or TikTok are not sponsored, endorsed, or administered by those platforms.


12. Lost property

AIRE is not responsible for lost, stolen, or damaged personal property. Items found in the Venue are held for 14 days. To inquire, contact info@airemia.com.


13. Intellectual property

The AIRE name, logo, marks, Site design, photography, video, and written content are owned by AIRE or its licensors and are protected by copyright and trademark law. You may not use them without our prior written permission, other than sharing our published social content in the ordinary way those platforms allow.

Content you tag or submit. If you tag AIRE, use our hashtags, or send us content, you grant us a non-exclusive, royalty-free, worldwide license to repost and use that content across our channels and marketing, with credit where practical. You confirm you own the content or have the rights to grant this license.

Copyright complaints. If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to info@airemia.com including identification of the work, the location of the material, your contact information, a statement of good faith belief, and a statement under penalty of perjury that you are authorized to act.


14. Third-party links and services

The Site links to third-party services including ticketing, reservations, payment, and social platforms. We do not control those services and are not responsible for their content, terms, or practices.


15. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, AIRE disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that event information on the Site is complete or current.


16. Limitation of liability

To the fullest extent permitted by Florida law, AIRE and its owners, officers, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, arising from your use of the Site, your attendance at the Venue, or any event, whether based in contract, tort, or any other theory.

Our total aggregate liability for any claim arising out of these Terms, the Site, or your attendance is limited to the greater of the amount you paid to AIRE for the relevant ticket or reservation, or one hundred dollars.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or personal injury where Florida law does not permit limitation.


17. Indemnification

You agree to indemnify and hold harmless AIRE and its owners, officers, employees, contractors, and agents from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising from your violation of these Terms, your conduct at the Venue, or your violation of the rights of any third party.


18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms, the Site, or the Venue shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Miami-Dade County, Florida. You and AIRE waive the right to a jury trial and the right to participate in a class action. Either party may bring an individual claim in small claims court. You may reject this arbitration provision by sending written notice to info@airemia.com within 30 days of first accepting these Terms.


19. General

Changes. We may update these Terms at any time. The "Last updated" date will change and, for material changes, we will post notice on the Site. Continued use of the Site or entry to the Venue after an update means you accept the revised Terms.

Severability. If any provision is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce any provision is not a waiver of it.

Entire agreement. These Terms, the Privacy Policy, and any separate written agreement for a private event or ticket purchase make up the entire agreement between you and AIRE.
